Summary

The facility failed to protect residents from physical abuse involving two residents, both of whom had behavioral and psychiatric histories. R4 was a female resident with diagnoses including major depressive disorder, anxiety disorder, alcohol abuse, bipolar disorder, and a history of falls. R5 was a female resident with diagnoses including COPD, iron deficiency anemia, major depressive disorder, history of falls, weakness, need for assistance with personal care, difficulty walking, and dependence on supplemental oxygen. The facility’s incident reports documented repeated verbal and physical altercations between the two residents, including an incident in which R4 reported that R5 grabbed the back of her shirt, another in which R4 pulled sunglasses from R5’s hair and R5 sustained scratches, and a later incident in which R5 pushed a rolling walker toward R4, causing R4 to fall and both residents to be transported to the hospital for evaluation. The records also showed that R4’s care plan identified maladaptive behavioral symptoms related to chronic mental illness, including aggressive behavior toward R5, and directed R4 not to enter R5’s room. R5’s care plan identified her as at risk for abuse, neglect, exploitation, and trauma and noted prior reports involving R4 and another resident. During interviews, R4 stated that she and R5 had prior conflicts and described being pulled, yelled at, and pushed by R5. R5 stated that R4 entered her room yelling and that she pushed R4, acknowledging that R4 was not supposed to enter the room. Staff interviews described hearing yelling from R5’s room and observing the residents physically fighting and punching each other, with one CNA reporting both residents attempting to strike each other and R4 on the floor. The administrator confirmed the investigation substantiated physical contact and altercation between R4 and R5.
