Failure to Timely Report and Investigate Abuse Allegations
Summary
The facility failed to ensure allegations of abuse were reported to the California Department of Public Health within 2 hours and that investigation summaries were submitted within 5 working days for multiple incidents involving residents and staff. The report identified 11 residents involved in allegations including resident-to-resident altercations, resident-to-staff allegations, and staff-to-resident allegations. These incidents included a resident entering two other residents’ room and breaking belongings while cursing and yelling, a resident throwing water at another resident, a resident being yelled at by a CNA about urinating on herself, a resident slapping another resident’s hand, a resident allegedly grabbing another resident after being called “dude,” a CNA allegedly instructing a resident to urinate in her brief instead of assisting her to the restroom, and a CNA allegedly hurting a resident while providing personal care. For several incidents, the facility’s notifications and investigation summaries were not received by the Department until months after the allegations were known to the Administrator. In one case, the Administrator stated the abuse involving three residents was initially sent to an incorrect email address rather than the Department’s address. Other incidents were documented on SOC 341 forms and later appeared in the Department’s message log only when the investigation summaries were received. One resident-to-resident incident had no documented evidence that the investigation summary was sent by the required deadline. Another allegation involving a resident and a CNA was not reported until the investigation summary was received by the Department months later. For the allegation involving a CNA and a resident who said she was hurt during personal care, the resident reported the concern to nursing staff after breakfast, and a CNA acknowledged being told about it that morning. The CNA said she informed the Director of Staff Development later that day, and the Administrator acknowledged notifying the Department that afternoon after already interviewing the resident. The Administrator also acknowledged that the notifications and investigation summaries for the other listed allegations were submitted late because the email address used was incorrect.
