Failure to Protect Residents from Abuse
Summary
The facility failed to ensure that one resident was free from physical abuse by another resident. A complaint received through the SA complaint tracking system reported that two residents had a verbal altercation in the dining room, after which one resident used her electric chair to hit the other resident in the leg. The injured resident had diagnoses including heart disease, pneumonia, dementia, anxiety, and hypertension, and a BIMS score of 7 indicating significant cognitive impairment. Her care plan noted communication problems related to dementia and hard of hearing, and a behavioral care plan addressed psychosocial well-being concerns related to dementia and cognitive communication deficits. Clinical documentation and staff interviews described that the injured resident told staff the other resident rammed into her with the wheelchair. A progress note stated that a CNA reported verbal and physical aggression from the other resident, including the other resident becoming verbally upset after a request about a napkin, confronting the injured resident, and then attempting to ram into her with the electric wheelchair, resulting in a 3 x 1 abrasion on the left lower leg. During interview, the injured resident stated she was scared, believed the other resident tried to hit her on purpose, and said she had to place a trash can between them because she feared the other resident would hurt her. An observation during the interview noted a dark purple mark on the left lower leg where the wheelchair contacted her. The facility also failed to ensure that another resident was free from abuse by staff. That resident had diagnoses including Parkinson’s disease, schizoaffective disorder, dementia, hypertension, atrial fibrillation, anxiety, and depression, and a BIMS score of 9 indicating significant cognitive impairment. The resident reported that a CNA stepped on his foot on purpose while he was turning to sit in his wheelchair, and he stated that all of his toes were broken and that he was afraid to report it because staff would come after him. Multiple CNAs described the staff member as rude, loud, rough with residents, and abusive, and one CNA stated the resident did not want that staff member caring for him because she was rough with him. The DON stated the staff member had been removed from the schedule and terminated, and that the facility had substantiated internally that the staff member was abusive and had stepped on the resident’s foot.
