Failure to Respond to Suspected Abuse During Medication Administration

Birmingham Nursing And Rehabilitation Ctr LlcBirmingham, Alabama Survey Completed on 10-29-2025

Summary

The facility failed to provide oversight and guidance to ensure its abuse prevention policy was implemented after an incident in which an LPN placed a hand over a resident’s mouth and pinched the resident’s nose during medication administration to prevent the resident from spitting out medication. Two staff reported that the resident’s face was red after the incident. The report states that the CNA who witnessed the event left the resident alone with the LPN and did not report the incident immediately, and another nurse who was told about it did not intervene or escalate the concern. The resident involved was identified as having been subjected to abuse during medication administration, and nurses interviewed stated that what occurred was abuse and that the resident was likely to aspirate the medications during the incident. The facility’s administration did not ensure staff intervened to protect the resident from further suspected abuse, did not ensure timely reporting to the ADM or DON, and did not ensure staff understood the protocol for immediately reporting allegations of abuse or the resident’s right to refuse treatment. The ADM later stated the allegation should have been reported immediately, and the DON stated staff should not leave the resident alone and should make sure the resident is safe when abuse is suspected. The ADM and DON also failed to identify the incident as abuse and failed to implement appropriate corrective actions to protect the resident and other residents. The report states that the LPN was allowed to return to work and continue administering medications without oversight or monitoring, and was observed administering medications during the survey. The facility determined the incident was not abuse at first, despite staff statements that the conduct involved placing a hand over the resident’s mouth and pinching the nose to force medication administration.
