Summary

The facility failed to provide basic life support, including CPR, for a resident who was documented as Full Code and whose POLST indicated that resuscitation/CPR should be attempted if the resident had no pulse and was not breathing. The resident had diagnoses including COPD, chronic heart failure, and ischemic heart disease, and the H&P indicated the resident had the capacity to understand and make decisions. The POLST was signed by the resident and MD 2 and stated that if the resident had no pulse and was not breathing, resuscitation/CPR should be attempted. On the morning of the event, LVN 1 was unable to obtain the resident’s vital signs during medication pass and called RN 1 to the bedside. RN 1 assessed the resident and found the skin warm to the touch, no response to verbal or physical cues, no chest rise and fall, and no detectable pulse. RN 1 notified MD 1, who pronounced the resident expired. RN 1 stated she did not attempt CPR and instructed LVN 1 not to perform CPR or call 911 because she believed the POLST indicated DNR. The facility’s records also showed that the resident’s IDT meeting document indicated the resident wished to be Full Code. The facility’s Emergency Procedure-Cardiopulmonary Resuscitation policy stated that if a resident is found unresponsive, staff should assess for abnormal or absent breathing, begin CPR if sudden cardiac arrest is likely, activate the emergency response system, and call 911. The DON stated that when a resident is found unresponsive and has no pulse, staff should immediately start chest compressions and call 911, and that the resident’s POLST must be honored. The facility’s POLST/advanced directive policy stated the facility will honor a resident’s completed POLST form and review it with the resident or responsible party.
