Summary

The facility failed to protect a resident's right to be free from abuse when two residents were involved in a physical altercation that resulted in one resident being choked, causing visible bruising and a sore throat. Prior to the incident, the resident who was later choked had been agitated and verbally aggressive, with staff noting the resident was yelling at others about food issues. Despite this agitation, the resident was allowed to go outside to the patio, where the altercation with another resident occurred. The failure to intervene before the situation escalated resulted in physical harm to a resident, in violation of the facility's abuse prevention and prohibition program.
