The resident was transferred to a general acute care hospital and did not return to the facility. The request for records was made by the resident's attorney, with an authorization signed by a family member, requesting all writings related to the resident for legal matters. The facility's policy required timely provision of requested protected health information, which was not adhered to in this case.
