The facility did not verify the positive results of the Department of Justice (DOJ) background check against the BID form, nor did it obtain references for the CNA as part of the hiring process. This lack of thorough screening allowed the CNA to care for a resident who later alleged sexual assault. This deficiency created a finding of immediate jeopardy, indicating a reasonable likelihood for serious harm.
