The administrator explained the appeal process and provided the resident with a copy of the notice, which was also mailed to the ombudsman office. However, the resident's medical record lacked documentation that the resident or their representative received a written notification of discharge. The administrator later acknowledged that the resident was very impaired when the discharge was discussed and given, and admitted that the resident might not have understood the discharge notice. The resident confirmed that they were not given a 30-day written notice before being sent to the emergency room for detoxification. Instead, the resident learned about the discharge from a social worker at the hospital. The facility's policy required written notification in a language and format understood by the resident or their representative at least 30 days prior to a facility-initiated discharge, which was not adhered to in this case.
