The Administrator acknowledged the lack of a specific contract with the company providing the caregivers and admitted that it was the responsibility of the facility's staff to ensure the safety of residents, staff, and visitors. The facility's policies required that nurse aides possess appropriate skills and competencies, and that their certifications be verified through the state registry, which was not done in this case.

During an interview, Human Resource Employee E9 confirmed that the facility failed to ensure these two nurse aides received the required yearly in-service education.

The Nursing Home Administrator later stated he could not find documentation in the previous DON's office related to any 12-hour training for the GNAs.
