The facility's policy on bed-hold agreements, governed by the Texas Administrative Code, mandates that signed agreements be obtained at the time of discharge. The policy allows for verbal agreements to be documented if the resident or representative cannot sign in person. However, the facility had not adhered to this policy, as evidenced by the lack of bed-hold agreements provided to residents transferred to the hospital. This failure could result in residents not being informed of their rights and the facility's bed-hold policy, potentially leading to improper discharges and unsafe conditions.
