Incomplete consent for antipsychotic medication

Vidor Health & Rehabilitation CenterVidor, Texas Survey Completed on 07-15-2026

Summary

The facility failed to ensure a resident was fully informed in advance of the risks and benefits of antipsychotic treatment and that proper consent documentation was completed for Risperidone. Resident #3 was a female admitted and readmitted to the facility with diagnoses including bipolar disorder, and her quarterly MDS showed a BIMS score of 03 out of 15, indicating severely impaired cognition. Her care plan identified the need for antipsychotic medications related to bipolar disorder and included an intervention to educate the resident, family, and caregivers about risks, benefits, and side effects. Record review showed Resident #3 had a physician order for Risperidone 0.5 mg by mouth twice daily for bipolar disorder and received the medication daily during May, June, and July 2026. The EMR contained an HHSC Form 3713 dated 04/07/24 and another dated 01/14/25 for Risperidone, but both forms were incomplete. The earlier form lacked a vendor number, dosage and frequency in Section I, and the prescriber signature. The later form lacked a vendor number, the resident's SS number, dosage and frequency in Section I, information identifying who was giving consent and on whose behalf in Section II, and the signature of the resident or resident representative; it was signed by a staff member with verbal consent from the POA. During interview, the RCN/former DON stated the form should have been completed with all missing information before upload and said she did not realize verbal consent could not be obtained for HHSC Form 3713. She also stated she could not make out which staff member signed as receiving verbal consent. The Administrator stated nursing staff were responsible for ensuring medication consents were signed and in place for psychotropic medications, and that not obtaining completed consents before administering psychoactive medications could take away the resident's right to be informed regarding medications and possibly the right to refuse treatment.
