Summary

The facility did not ensure that an alleged abuse-related injury was reported to the State Agency and law enforcement within the required timeframe. Survey review found that R1 developed a large bruise to the upper right arm that was first noted by nursing staff, and the facility began an injury of unknown origin investigation. Staff determined the bruise may have been related to a blood pressure cuff or a mechanical sit-to-stand lift, and abuse and neglect were ruled out internally. However, the injury was not reported to the State Agency within 24 hours of becoming aware of it, and law enforcement was not updated regarding suspicion of a crime. During the investigation, staff interviewed were unable to identify how the injury occurred, and R1 stated that no one at the nursing home had hurt them and that they did not know how the injury happened. The bruise was described as large and rectangular in appearance, and R1 later developed pain in the right arm. The facility’s investigation included staff interviews and communication with the primary provider and POA, and surveyors determined the investigation itself was thorough. Even so, the facility did not submit the initial report within 24 hours after becoming aware of the injury, and the report to the State Agency was made only after the fracture was identified and the Director of Social Services was notified. Facility leadership stated they did not consider the initial bruise reportable because they believed abuse had been ruled out and the injury was caused by a blood pressure cuff or mechanical lift.
