Summary

The facility failed to ensure residents were free from sexual abuse when one resident grabbed another resident’s breast in a hallway. The incident was captured on facility video, witnessed by other residents, and reported to staff. Witnesses stated the resident who was touched screamed when the other resident made contact. Staff also reported that two weeks earlier, the same resident had made inappropriate sexual comments to the other resident. The resident who initiated the contact had diagnoses including encephalopathy, type 2 diabetes mellitus, schizoaffective disorder, and dysphagia, and a quarterly MDS documented a BIMS score of 05/15 with behavioral symptoms directed toward others. Records showed physician involvement and behavioral monitoring orders related to sexual behaviors toward peers and staff. The resident who was touched had diagnoses including cerebral palsy, impulse disorder, hypotension, and unspecified intellectual disabilities, with MDS documentation of moderate cognitive impairment, verbal behavioral symptoms, and wandering. Records also showed behavior monitoring, line-of-sight or 1:1 supervision at times, and notes describing yelling, screaming, grabbing other residents’ food, and inappropriate touching behaviors. Facility staff and leadership acknowledged the incident and described the residents as vulnerable. The administrator stated the event was investigated and confirmed contact occurred between the residents. The administrator also acknowledged that two abuse incidents involving the resident who was touched occurred within a three-month period. The facility policy stated residents have the right to be free from sexual abuse and defined sexual abuse as non-consensual sexual contact of any type with a resident.
