Summary

The facility failed to protect two residents from physical abuse by another resident. The deficiency involved a resident with Parkinson’s disease, dementia, and severe cognitive impairment who was identified as the aggressor, and two other residents who were involved in the incident as victims. The facility policy stated residents have the right to be free from abuse, including physical abuse, and that residents must be protected from abuse by anyone, including other residents. According to the investigation, one resident threw water on another resident, causing that resident to cry. A third resident confronted the aggressor about the behavior, and the aggressor became upset, cursed at the resident, and pushed her, causing her to fall to the floor and land on her buttock. The resident who was pushed was assessed, assisted back to her wheelchair, and had no visible injuries at the time, though later reported mild pain in her buttock and right elbow. The facility substantiated physical abuse based on witness statements and video surveillance. The second resident involved was found wet after the aggressor threw water on him. No injuries were noted and he denied pain or distress. Records showed the aggressor had a history of poor impulse control related to dementia and had been involved in physical altercations with peers as the aggressor. The two victim residents had diagnoses including vascular dementia, bipolar disorder, intellectual disability, diabetes, and heart failure, and both were described as cognitively impaired. Interviews with facility leadership confirmed that pushing another resident or throwing water on another resident would be considered abuse.
