Summary

The facility failed to promptly report an alleged verbal altercation between two residents to law enforcement within the required regulatory timeframe. On 6/9/26, a CNA reported to LVN 2 that Resident 4 was having a verbal argument with Resident 5. LVN 2 and LVN 3 went to the room and found the residents separated, with Resident 4 in bed and Resident 5 seated in her bed. When asked about the incident, Resident 4 said she was waiting for a diaper change, and Resident 5 said Resident 4 was lazy and needed to get up and work. The incident reports and SBAR notes show the MD and both residents’ responsible parties were notified the same day, and the 5-day summaries later indicated that two state agencies were notified and supporting documents were faxed. Resident 4 had diagnoses including dementia and hearing loss, was sometimes understood and sometimes able to understand, and had severely impaired cognition; Resident 4 was totally dependent for all ADLs. Resident 5 had dementia with other behavioral disturbance, was sometimes understood and sometimes able to understand, and had severely impaired cognition; Resident 5 required substantial to maximal assistance for all ADLs. The facility was unable to provide written documentation that law enforcement was notified of the alleged incident. During interview, LVN 2 stated the DON contacted law enforcement but was told to follow facility protocol, and the Administrator was also unable to provide written documentation supporting that the DON contacted law enforcement. The facility policy stated that alleged abuse must be reported to law enforcement immediately, but not later than two hours when abuse is alleged.
