Summary

The facility failed to identify and report a potential allegation of abuse and/or neglect for Resident 1 and failed to report the results of abuse and/or neglect investigations within 5 days for Residents 1, 2, and 3. Resident 1 was admitted with diagnoses including developmental delay since childhood, depression, and pain, and the admission MDS showed intellectual disability with severe impaired cognition. During a care conference, the facility was alerted to bruising on Resident 1’s arm, and the investigation documented bruising on the left upper arm, abdomen, and both legs. A collateral contact stated that several bruises were observed on Resident 1’s upper arms, upper leg area, and lower abdomen during the visit, and the bruises were brought to the attention of the facility with a nurse manager present. The facility state reporting log showed no logged results report for Resident 1’s unexplained bruises to the upper arms, torso, or legs. The facility also failed to report the results of a resident-to-resident abuse allegation involving Residents 2 and 3. Resident 2 was admitted with bipolar disorder, anxiety, and depression, and the quarterly MDS documented intact cognition. Resident 3 was admitted with depression and anxiety, and the quarterly MDS documented intact cognition with physical behaviors toward others for 1 to 3 days of the look-back period. The facility investigation documented that staff found Resident 2 crying in their room and that Resident 2 reported Resident 3 had verbally abused them outside at the smoking area after Resident 2 refused to give Resident 3 a cigarette. Resident 2 also stated Resident 3 was invasive and followed them into the facility making comments. The state reporting log showed no logged results report for the allegation involving Residents 2 and 3. Staff stated that unknown bruising, especially on the torso or upper legs, should be reported to the state, and the DON confirmed that all potential allegations of abuse and/or neglect should be reported immediately and logged within five days.
