Summary

The facility failed to provide a resident with written decisions on grievances he submitted. The resident, admitted to the facility on [DATE], requested written responses to multiple grievances documented in the facility’s Report of Concern forms. In one grievance, he stated that staff entered his room before 06:00 AM for medications and treatment despite an established expectation that he not be disturbed between 11:00 PM and 06:00 AM, and he asked for the facility’s response in writing. In another grievance, he requested daily baths in the shower room and again asked for a written response. In a later grievance, he stated he did not receive his scheduled shower and requested a written response, but the second page of the report was blank where the outcome, corrective actions, and contacts during the investigation were to be documented. During interview, the resident stated he had requested written responses to his grievances but had never received one. Social Services staff stated she typically provided written responses and was aware it was a resident right to receive one, but said she had been told not to give the resident written responses. Administrative staff stated grievances were addressed in person or in writing and that residents received written or verbal summaries, but also stated that if a resident had the same grievance repeatedly, the facility did not always provide a written response and that he did not know it was a resident right to receive a written decision. The facility’s grievance policy stated the resident had a right to obtain a written decision regarding his or her grievance.
