Summary

The facility failed to implement written policies and procedures to prevent abuse when it did not properly report and thoroughly investigate two separate allegations involving a CNA and Resident #1. Resident #1 was a readmitted female resident with schizoaffective disorder, dementia, muscle wasting, and difficulty walking. Her quarterly MDS indicated she was rarely or never understood, needed assistance with eating, dressing, hygiene, and toileting hygiene, and lived on the women’s secured unit because of elopement risk, inappropriate sexual behaviors with male residents, and poor safety awareness. One allegation involved a hospitality aide who reported that CNA B was being rough with Resident #1 in the shower. The hospitality aide stated that CNA B said staff had to be rough with Resident #1 sometimes, pulled her off the bed by the arms causing her to fall, and later placed her hands on Resident #1’s shoulders and pushed her down into the shower chair. The hospitality aide said she reported the incident to the LVN and then contacted the DON, ADON, and ADM by phone and text. The DON and ADON stated they were not aware of an abuse allegation at the time, and the ADM later stated she did not believe the hospitality aide was credible and did not consider the incident reportable to the state. A second allegation involved a housekeeper who observed CNA B guide Resident #1 toward a dining room chair and then place both hands on the resident’s shoulders and push her down into the chair while the resident said, “no, no, no.” The housekeeper said she did not initially report it because she did not feel it was abusive, but later wrote a statement and placed it under the ADM’s office door. The facility’s records showed the housekeeper’s written statement described the resident resisting while being guided to the chair, and the ADM stated she investigated by interviewing staff and assessing the resident, but no report was made to the state at the time of the allegations.
