Failure to Implement Restorative Nursing and Splint/Brace Programs After Therapy Discharge

The facility’s undated Restorative Nursing Services policy stated that residents would receive restorative care as needed to achieve and maintain optimal functioning and that residents may initiate a restorative program upon discharge from rehabilitative care. Despite this, surveyors found that residents with documented hemiplegia, hemiparesis, weakness, and contractures were not placed on restorative programs and had no restorative interventions documented in their electronic health records (EHRs). Resident 1 was admitted with hemiplegia and hemiparesis following cerebrovascular disease, a left lower leg fracture, and weakness, and the admission MDS showed intact cognition, moderate assistance needs for bed mobility and transfers, and one-sided upper and lower extremity impairment. During observation, the resident was seen lying in bed with a bent inward left forearm and hand and reported no longer receiving therapy or nursing-assisted exercises. The care plan initiated in January showed no restorative services, and the care plan history and EHR contained no restorative nursing interventions. However, the PT discharge summary from February documented that restorative ROM and transfer programs had been established and trained, including PROM to the left upper and lower extremities and stand-by assist with transfers, and the OT discharge summary recommended a splint/brace to prevent contracture. The OT stated that the splint/brace was not tried due to lack of time before insurance was discontinued, and both the Director of Rehab and the MDS coordinator confirmed there was no restorative referral in the EHR and they were unaware of the recommendations. Resident 2 was readmitted with hemiplegia and hemiparesis following a nontraumatic subarachnoid hemorrhage, a left-hand contracture, and weakness, and the quarterly MDS showed intact cognition, maximum assistance needs for bed mobility, total assistance for transfers, bilateral upper and lower extremity impairment, and no therapy or restorative programs. The resident reported that therapy had been discontinued months earlier and that no restorative staff were assisting with exercises. The care plan and EHR showed no restorative services. OT evaluation documented left upper extremity ROM impairment, a left-hand contracture, and prior use of a left orthotic to manage flexion tone, and the OT discharge summary recommended restorative care and assistance with donning/doffing the orthotic. The PT discharge summary recommended restorative programs if Medicaid Part B services did not continue. The Director of Rehab confirmed therapy was discontinued and that restorative nursing programs were recommended, but both the Director of Rehab and the MDS coordinator stated there were no restorative referrals in the EHR after readmission, and the MDS coordinator confirmed the resident had no restorative programs since readmission.

A progress note stated the restorative program and splinting were discontinued per recommendations related to resident refusal, and the care plan, tasks, and restorative aide were updated. The restorative flow sheet showed three refusals of splint assistance between 05/14/2026 and 06/04/2026, with documentation that the resident was re-approached by alternate staff and then agreeable to wear the splint. The restorative aide stated they had no experience with the resident refusing splint assistance, and the DOR stated that three refusals in 30 days was uncommon and did not meet expectations for discontinuing the restorative program.

The resident stated staff allowed the splint to be applied. Staff 8, a CNA, stated the resident's hand contractures were stiff and difficult to manage and admitted she did not offer to apply the brace during her shift because she forgot. Staff 9, an LPN, stated the resident used bilateral hand splints to prevent further decrease in ROM, tolerated them, and allowed staff to apply them, but staff did not tell her they were unable to apply the splint during the day. Staff 10, the RN Resident Care Manager, stated he was unsure why the resident did not wear the hand splint consistently and acknowledged the splints should be worn.

CNA O was unsure whether restorative care was being provided, CNA M stated the resident did not receive restorative care, and Administrative Nurses E and D confirmed the resident had not been receiving the planned restorative nursing cares for the left-hand contracture.

The facility policy stated residents with limited ROM will receive treatment and services to increase and/or prevent further decrease in ROM.
Failure to Provide and Document Contracture Management for Left Hand ROM

Resident #4 was an older male with diagnoses including stiffness of unspecified joint, muscle wasting and atrophy of the upper arm, unsteadiness on feet, cognitive communication deficit, unspecified intellectual disabilities, and poly osteoarthritis. The record showed a care plan for skin integrity problems related to an abrasion to the left palm, pain related to arthritis and left hand contracture, and physical mobility related to weakness and a contracted left hand, with interventions including a foam roll to the left hand, abductor wedge, halo bars, and monitoring for worsening contracture and skin breakdown. Record review showed the active order summary did not include an orthotic device or foam roller/abduction wedge for mobility intervention, and the task list did not indicate the frequency of foam roller use or splint use. Occupational therapy documentation stated the resident received therapy for contracture management and had decreased hand and wrist ROM, with recommendations to begin with foam tubing in the left palm and progress to larger tubing and eventually an orthotic carrot. OT goals included wearing orthotic foam tubing in the left palm for up to 2 hours, then up to 8 hours with minimal redness, swelling, discomfort, or pain. The OT progress report also noted the facility did not have a restorative program and nursing staff would continue promoting participation in ADL tasks such as contracture management after OT discharge.

The facility failed to ensure that Restorative Therapy for range of motion (ROM) and splint application were provided as ordered for one resident with severe cognitive impairment and dependence for activities of daily living, mobility, and transfers. The resident had diagnoses including traumatic hemorrhage of the right cerebrum, disorder of the autonomic nervous system, neurocognitive disorder, and aphasia. The resident was observed lying in bed with arms and hands resting on top of the blankets and hands closed in fists, and a hand splint was observed placed on top of a drawer under the television rather than on the resident. The resident was later observed in a reclining wheelchair in the common area without the hand splint on. The resident’s restorative orders included active ROM to both upper and lower extremities 5 to 7 days per week and splint use to the right upper extremity for 2 hours on and 2 hours off, 5 to 7 times per week. The restorative documentation showed inconsistent completion, including entries indicating ROM and splint goals were not meeting the goal and that the plan was not occurring as ordered. The monthly restorative records also reflected limited participation counts for ROM and splint/brace programs. Interviews with the resident’s confidential visitors reported that staff were not repositioning the resident every two hours, were not completing ROM exercises, and were not consistently applying the hand splint. The visitors stated that staff often said they were short staffed and pulled to the floor. A CNA assigned to the resident reported being pulled to floor assignments and stated that when pulled, restorative therapy tasks could not always be completed. The MDS nurse reported that restorative tasks were entered for daily completion, that CNAs assigned to the resident were responsible if the restorative aide could not do the plan, and that she was unsure why the ROM and splint application were not being completed. The therapy director stated the ROM and splint plan was intended to maintain ROM and positioning, and the administrator and corporate nurse reviewed that the documented look-back showed ROM and splint application were not completed as ordered.
