Abuse of Two Residents by CNA

Summary

The facility failed to ensure that two residents remained free from physical and mental abuse when a CNA used aggressive and rough handling toward one resident and intimidating behavior toward another. Resident #10 had diagnoses including severe dementia, Alzheimer's disease, and schizoaffective disorder, bipolar type, and had a trauma-informed care plan that called for staff to maintain a calm, non-threatening manner, provide reassurance, respect boundaries, and offer emotional support. On 09/26/2025, the CNA was observed speaking in a loud tone to Resident #10, grabbing the resident by the left arm with excessive force, pulling the resident off a couch near the Nurse's Station, and roughly placing the resident's baseball cap on the resident's head. Resident #13 had diagnoses including Parkinson's disease with dyskinesia and fluctuations, unspecified dementia, major depressive disorder, anxiety disorder, and PTSD. On the same date, Resident #13 witnessed the interaction between the CNA and Resident #10 at the Nurse's Station. The CNA then approached Resident #13, told the resident it was time for bed, and when the resident did not respond, snapped fingers twice in front of the resident's face while getting closer. Resident #13 asked the nurse if the nurse had seen how close the CNA had come and later stated the resident did not want care from the CNA and was afraid of the CNA. Witness statements from staff documented the CNA speaking in a loud voice, showing a lack of consideration for Resident #10's feelings, using an aggressive tone, grabbing the resident's arm with excessive force, and handling the baseball cap roughly. The same statements documented the CNA's conduct toward Resident #13, including snapping fingers in the resident's face and moving too close. The facility's investigation later substantiated the abuse allegations involving both residents.

After the resident was stable for return, the DON and administrator went to the hospital and, along with the owner and corporate administrator on speaker phone, were reported by the resident and hospital staff to have yelled, been rude and aggressive, and told the resident the facility would not take the resident back because of behaviors and money owed. The resident stated feeling pressured, outnumbered, and insignificant.
