Failure to Offer and Document COVID-19 Vaccine Education and Consent
Summary
The facility failed to ensure residents and/or their representatives were offered education on the COVID-19 vaccine, including the risks versus benefits and potential side effects, and failed to properly document vaccination status for 5 of 5 sampled residents reviewed for immunization status. Resident 61 was admitted with respiratory failure, anxiety, and depression, was cognitively intact, and was not up to date on the COVID-19 vaccine; the record showed the resident had not been offered the opportunity to accept or refuse the vaccine and had not been educated on its risks, benefits, or side effects. During interview, the resident stated they had not received any information or been approached about the vaccine and would want information to make a decision. Resident 2 was admitted with wound infection and depression, was cognitively intact, and was also not up to date on the COVID-19 vaccine; the record showed no offer to accept or refuse the vaccine and no education on risks, benefits, or side effects. The resident stated they had previously received other vaccines and had obtained the influenza vaccine outside the facility. Resident 72 was admitted with heart/lung complications and a bladder infection, had moderate cognitive impairment but could make needs known, and was not up to date on the COVID-19 vaccine. The immunization informed consent record showed the resident refused the vaccine, but there was no documentation that education on risks versus benefits or potential side effects was provided when the vaccine was refused. Resident 35, admitted with heart complications, anxiety, and depression, had moderate cognitive impairment, could make needs known, and was not up to date on the COVID-19 vaccine; the record showed no offer to accept or refuse the vaccine and no education documented. Resident 56, admitted with a lung condition, anxiety, and depression, was cognitively intact, could make needs known, and was not up to date on the COVID-19 vaccine; the record showed no offer to accept or refuse the vaccine and no education on risks, benefits, or side effects. The DON and Resource Nurse Manager stated the facility’s process was to offer the vaccine and complete consent forms with education, but acknowledged not all residents had been offered or educated and that the correct process was not being followed.
