During the meeting, Resident 38 stated residents were only given a copy of their rights if they asked for them, while Residents 21 and 46 said they did not remember ever being offered information on resident rights or having discussions about their rights. Resident 34 stated they were unable to exercise their rights if they did not know what their rights were, and the residents confirmed they had not seen posted information related to resident rights. Review of Resident Council minutes showed that on 06/23/2025, nine residents attended and copies of the Resident [NAME] of Rights were given to new residents, but the minutes did not identify which residents received them and did not document that the rights were discussed with all residents. On 07/28/2025, five residents attended and there was no documentation that resident rights were discussed or copies were provided. On 08/25/2025, six residents attended and three residents received a copy of the Resident [NAME] of Rights, but there was no documentation that the rights were discussed or reviewed with all residents. A poster titled, Know Your Rights, with an attached binder and laminated sheets was observed posted high on the wall next to the dining room, and it was not at a level readable or accessible for residents using wheelchairs. Staff stated residents were notified of their rights on admission and that resident rights should be reviewed and discussed periodically with all residents.

The DON stated the social service director worked with marketing and ordered items needed for the admission packets, and that they were not aware the RBOR had been updated. The SSD stated they did not personally go over the RBOR at admission and were not aware who was responsible for updating the posters or whether residents had been updated regarding the revised RBOR. A policy regarding RBOR was requested but not provided.

Upon admission, the resident signed numerous admission, financial, consent, and resident-right documents written in English, including the admission summary, financial policies, advance directives information, grievance procedure, non-discrimination notice, abuse and zero tolerance information, visiting policy, resident rights, and a legal arbitration agreement. The majority of these documents were also signed by the admissions director, Employee E8. Review of the resident’s record showed no documentation that the admission documents were translated into Spanish, interpreted by a qualified medical interpreter, reviewed through a language assistance service, or otherwise communicated in a manner the resident could understand before signatures were obtained. There was no documentation identifying an interpreter, translator, bilingual staff member, or witness to confirm the contents were accurately explained. The resident’s care plan identified communication needs, noting that staff should use nonverbal communication techniques, gestures, verbal and visual cues, and a Spanish-English communication board. During interview, the admissions director stated she does not speak Spanish, used a tablet for translation, and confirmed there was no notation showing a translation method was used, no Spanish paperwork, and no independent witness present during the signing process.
