Summary

The facility failed to protect a resident from abuse when another resident who was ordered to receive one-on-one supervision was left unattended and entered the resident’s room, where he struck the resident with a wheelchair footrest. The resident who was left unprotected reported that the other resident became agitated after he rang the call bell for assistance, yelled at him to stop ringing it, then rolled into his room and hit him. The resident stated he sustained a skin injury and pain in his right foot from the incident. The resident who was left unattended had diagnoses including paranoid schizophrenia, insomnia, major depressive disorder, and anxiety disorder. His record showed an active order for one-on-one supervision 24 hours a day because of aggressive behaviors and paranoid thoughts, and his care plan documented multiple resident-to-resident altercations and the need for one-on-one staff support. The facility’s one-on-one care acknowledgement form stated staff were to confirm relief for breaks before starting the assignment, never leave the resident unattended, and keep the resident within direct line of sight at all times. During interviews, multiple staff members and management confirmed that the resident should have been continuously supervised and not left alone. The activity assistant assigned to the one-on-one supervision stated he left the resident unattended for about five to eight minutes while taking a break after being unable to find coverage. He later observed the resident in the hallway returning toward his room and saw the other resident yelling at him. The administrator, assistant director of nursing, social service director, director of staff development, and nursing staff all confirmed that the resident was left unattended despite the one-on-one order and that the incident occurred when the assigned staff member stepped away.
