Failure to Ensure Up-to-Date Immunization Records and Vaccine Education

Resident 13, who was over the age of 50 and had multiple diagnoses including hypertensive heart disease and atrial fibrillation, did not have a Minnesota Immunization Information Connection (MIIC) report, and the facility could not provide any immunization history. Similarly, Resident 40, also over the age of 50 with conditions such as spastic hemiplegia and nontraumatic intercerebral hemorrhage, lacked an MIIC report and immunization history. Interviews with registered nurses revealed uncertainty about the residents' vaccination status and whether follow-ups had been conducted. The facility also failed to educate and offer pneumococcal vaccines to residents upon admission. Resident 17, who had a history of cerebrovascular disease and diabetes mellitus, was eligible for a pneumococcal vaccine according to CDC guidelines but was not offered one. The registered nurse was unaware of the CDC's PneumoRecs VaxAdvisor and relied solely on the MIIC for vaccine status, without consulting the resident's provider about vaccine eligibility. The director of nursing expected staff to review CDC guidelines and offer vaccines appropriately, which was not done in this case. Additionally, the facility did not provide education or offer the influenza vaccine to three residents. Resident 11, with chronic heart failure and other conditions, had an outdated influenza vaccine record, and there was no documentation of the vaccine being offered to Residents 13 and 40. The facility could not provide evidence of education about the influenza vaccine or signed declinations from the residents or their representatives. The director of nursing was unsure of the process if a resident declined the vaccine, indicating a lack of clear procedures for handling vaccine refusals.

One resident had acute kidney failure with tubular necrosis and the other had ESRD; both charts lacked immunization data in the EMR and care plan. Staff interviews showed the ADON, DON, DCE, and Administrator each described admission paperwork and EMR entry responsibilities, but the required vaccine documentation was not present.
Failure to Offer Flu and Pneumococcal Vaccinations: The facility did not document offering influenza vaccination to two residents or their representatives, and the DON confirmed the pneumococcal status for those residents was not up to date after reviewing CDC guidance. Resident 56 was admitted in 11/2021 with diagnoses including COPD and asthma. Records showed the resident last received PPSV23 on 2/27/23, with no documentation of pneumococcal consent after 2/23/24 and no documented evidence that the resident was offered or declined PCV15, PCV20, or PCV21. Resident 56 stated on 6/5/26 that she would have wanted to have been offered the pneumococcal vaccination. Resident 7 was admitted in 4/2024 with diagnoses including chronic heart failure and diabetes. Records showed the resident last received PCV13 on 7/17/17, with no pneumococcal vaccination consent after that date and no documented evidence that the resident was offered or declined PCV20 or PCV21. Resident 7’s 4/30/26 Quarterly MDS indicated severe cognitive impairment. Staff 15, the Infection Preventionist, stated she had developed a tracking system and found residents were past due for vaccinations, knew Resident 7 and Resident 56 were due for pneumococcal vaccinations, but had not offered them. Staff 15 stated she struggled completing past due vaccinations because she was pulled to other nursing and staffing coordination tasks. Staff 2, the DNS, confirmed knowing Staff 15 was working on past due vaccinations but did not confirm knowing specific residents.

Resident #115 was admitted with end stage renal disease, and the record review did not reveal cognition or immunization status information in the entry MDS. For both residents, the immunization tab in the electronic medical record showed no data available, and the care plans did not include immunization information. During interviews, the ADON, who said she was the facility’s Infection Preventionist, stated residents were asked on admission about flu, pneumonia, and COVID vaccines and that refusals should be documented. She said immunization information should have been entered in the electronic medical record or admission packet and that she was responsible for entering vaccine information. The DON stated obtaining immunization information fell to the infection control nurse, though nursing management and admitting staff could also assist. The DCE and Administrator stated the admission packet contained vaccine information and consents and that admissions paperwork was the responsibility of the DCE or Admissions, but the DCE was new to the facility and the prior DCE had left before the current one started.
Failure to Offer Influenza and Pneumococcal Vaccinations

Review of R76’s record showed admission on 08/05/21, PCV13 on 04/05/17, influenza vaccine on 10/02/24, and no evidence that the resident was offered, consented to, or declined the 2025 influenza vaccine. Record review and facility documents showed both residents had personal immunization histories indicating prior pneumococcal vaccination, with the facility documenting them as up to date on pneumococcal vaccines. During interview on 05/29/26, the DON confirmed that R73’s and R76’s pneumococcal vaccines were not up to date after reviewing CDC guidelines, and stated there was no documented evidence that either resident was offered an influenza vaccine and accepted or declined it. The facility policies titled Pneumococcal Vaccination (Series) and Influenza Vaccination stated that residents are to be offered immunization in accordance with current CDC guidelines and annual influenza vaccination guidance.
